Counterfeit and Intellectual Property Policy
Last updated: 4 October 2026
Operator: Varun Enterprises ("OLDBUY", "we", "us", or "our").
1. About this policy
This Policy applies to listings, advertisements, images, descriptions, messages, and other user content on the OLDBUY website and mobile application (the "Platform"). It explains prohibited counterfeit and infringing content, reporting requirements, review procedures, and available account actions.
Read this Policy with our Terms of Use and Privacy Policy, particularly Sections II, III, IX, X, XV, XX, and XXI of the Terms. We handle reports in accordance with applicable Indian law, including applicable provisions of the Information Technology Act, 2000 and rules made under it, the Trade Marks Act, 1999, the Copyright Act, 1957, and consumer-protection requirements, as amended and in force. Mandatory legal requirements prevail over inconsistent policy wording.
2. Prohibited goods and content
You must not list, advertise, offer, or promote counterfeit goods or content that infringes another person's intellectual property rights. Prohibited examples include:
- Goods or packaging bearing unauthorised marks or branding that falsely represent the product as originating from a particular brand.
- Infringing branded copies described as "first copy", "master copy", or "replica". Disclosing that an item is fake does not make an infringing product permitted.
- Unauthorised copies of protected software, books, films, music, or other works, unless the use is permitted by the rights holder or applicable law.
- Listing photographs, artwork, descriptions, or logos used without the required permission or another lawful basis.
- False claims of brand affiliation, authenticity, dealership, certification, or authorisation, and forged invoices or authenticity documents.
A keyword, low price, or brand reference alone does not conclusively establish infringement. The nature of the item, the rights involved, the context, and available evidence must be considered. Accurately identifying the brand of a genuine item does not by itself establish an unauthorised affiliation.
3. Genuine resale and other lawful uses
Genuine second-hand goods may be listed where their acquisition, resale, and advertisement are lawful and comply with our Terms. A seller is not automatically required to be an authorised dealer merely to resell a genuine item.
We will not treat lack of dealer authorisation or an allegation about a private distribution agreement alone as conclusive proof that goods are counterfeit. However, genuine goods may still require action where there is a separate legal or policy violation, misleading description, relevant alteration or impairment, safety concern, or binding legal direction.
A lawful resale does not automatically authorise copying another person's product photographs or advertising material. Sellers must accurately disclose relevant used, repaired, refurbished, or modified condition and must not imply a manufacturer warranty that does not apply.
4. Seller responsibilities
- Have the ownership, authority, permissions, and other rights required to list the item and publish the content.
- Use accurate descriptions and genuine supporting information. Do not list an item as authentic if you have no reasonable basis for that claim.
- Cooperate with reasonable requests for evidence, such as purchase records, product photographs, serial-number information, or relevant permissions. No single document guarantees authenticity; the absence of an original invoice alone does not prove counterfeiting.
- Redact unrelated personal and financial information from evidence. Do not send passwords, OTPs, or unnecessary identity documents.
- Do not repost removed content or use another account to evade a restriction while the decision remains in effect. Use the review process if you disagree.
5. OLDBUY's role and review measures
OLDBUY provides an online classifieds platform. We do not physically inspect, authenticate, possess, or deliver listed items. A live listing, paid placement, or seller badge is not certification that an item is genuine.
We may assess user reports, rights-holder notices, relevant listing information, supporting documents, and other lawfully available evidence to identify suspected violations. We may request further information or temporarily restrict content while a credible concern is reviewed. We do not promise that every listing is screened before publication or that all counterfeits will be detected.
These limitations do not exclude Varun Enterprises' obligations to handle complaints, comply with lawful directions, or meet other applicable requirements.
6. How to report a suspected violation
Any user may report suspected counterfeit or infringing content using an available reporting feature or by emailing oldbuy317@gmail.com. Identify the listing and explain the concern. You do not have to own intellectual property rights to report a suspected counterfeit item; if you claim to represent a rights holder, you must have the authority to do so.
For a formal rights-holder notice, address your email to Himanshu, grievance contact for Varun Enterprises (OLDBUY), with the subject Intellectual Property / Counterfeit Report, and provide:
- Your name, contact email, and the identity of the rights holder. Where relevant, include the business name and contact information reasonably needed to assess the claim.
- Your relationship to the rights holder and evidence of authority if you act as a representative.
- The right or protected work concerned, the relevant territory, and supporting evidence. Provide registration details where applicable. Copyright complaints may identify the original work and evidence of ownership or permission; a trademark certificate is not required for every type of complaint.
- The exact listing URL, listing ID, screenshots, or other details sufficient to locate each reported item or piece of content.
- A specific explanation of the alleged infringement for each listing, supporting evidence, and the action requested.
- A statement that you believe in good faith that the reported use is unauthorised, that your information is accurate to the best of your knowledge, and that you are the rights holder or authorised to act for them, together with your name or signature and the date.
Individual creators may submit notices. Company letterhead, incorporation, and a corporate email domain are not universal prerequisites. We may make proportionate checks of identity, authority, and the claim.
7. Notice review, decisions, and timeframes
We will acknowledge and handle complaints within the timeframes applicable under law, including any shorter deadline for a particular complaint, court order, or authorised government direction. We assess the applicable deadline from receipt as required by law; asking for clarification does not by itself restart or extend a statutory deadline.
Where information is missing, we may request clarification rather than automatically declare the entire notice void. Urgent or legally required action will not be delayed merely because an optional supporting detail is absent. A complaint alone does not conclusively establish infringement, and submitting a notice does not guarantee removal.
Depending on the evidence and applicable requirements, we may retain the listing, request corrections or evidence, temporarily restrict access, remove content, or take proportionate account action. Where appropriate and legally permitted, we will inform affected users of the action, its reason, and the available review channel. Notice or certain details may be withheld where required by law or reasonably necessary to protect security or an investigation.
8. Seller response and review
If you believe action was taken in error, email oldbuy317@gmail.com with the subject IP Listing Review Request. Include the listing or account identifier, the decision being challenged, your explanation, and relevant evidence of authenticity, ownership, permission, or another lawful basis.
We will assess the response and may seek clarification from the parties. Content may be restored when justified and legally permitted, but an appeal or a withdrawal of a private complaint does not automatically require restoration where another valid restriction remains. This review process does not replace applicable statutory appeals or access to a competent court or authority.
9. Repeated or serious violations and abusive reports
Established serious or repeated violations may result in listing restrictions, suspension, termination, or refusal of further access under the Terms of Use. We consider the nature, severity, history, and available evidence. Multiple unsupported accusations do not automatically establish repeat infringement. Forged evidence may itself justify account action.
Knowingly false, deceptive, or abusive notices are prohibited. We may seek stronger verification or reject unsupported claims, but concerns about a reporter's history do not excuse ignoring a credible new complaint, mandatory grievance process, or binding legal direction. This Policy does not create an automatic monetary fine; any compensation claim is governed by the Terms and applicable law.
10. Privacy, records, and lawful cooperation
Complaint details and supporting documents will be handled in accordance with our Privacy Policy and applicable law. We may share the allegation and information reasonably necessary for a fair response with the affected party. We will not automatically disclose an entire complaint, home address, identity document, or unrelated private contact information. Where a contact detail needs to be shared, we will use a lawful basis and provide notice or obtain consent where required.
We may preserve relevant records available to us for complaint handling, legal compliance, security, or a documented dispute, subject to appropriate access controls and necessary retention periods. We do not claim to hold records of payments or handovers that occurred outside the Platform.
We will respond to lawful requests and binding directions from competent authorities. Where appropriate and lawful, we may consider authentication guidance supplied by rights holders or facilitate communication between the parties. This does not guarantee a partnership with any brand or disclosure of user data on informal request.
11. Buyer assistance and disputes
If you suspect an item is counterfeit, stop any further payment, preserve the listing details and relevant communications, and report the concern. Buyers may also approach the seller, their payment provider, law enforcement, a consumer forum, or another competent authority as appropriate.
OLDBUY may review platform content and take action within its role, but does not make binding judicial findings about ownership or authenticity or guarantee recovery of money paid to another user. This does not exclude responsibility for our own obligations. Refunds or remedies concerning OLDBUY's Paid Services remain governed by Section V of the Terms.
Notify us of a relevant settlement or legal decision so that we can assess whether the listing or account status should change. Disputes involving Varun Enterprises are subject to Section XX of the Terms, without limiting mandatory statutory remedies.
12. Updates and contact
We may update this Policy and its last-updated date. Material changes will follow the notice and acceptance requirements in the Terms and applicable law.
