Term of use
Last updated: 4 October 2026
Legal operator: Varun Enterprises
Please read these Terms of Use carefully before using OLDBUY (the "Platform") and its services. By accessing or using the Platform, you acknowledge that you have read and understood these Terms and agree to be bound by them.
If you do not comply with these Terms, Varun Enterprises may restrict, suspend, or terminate your access to the Platform, remove content that violates these Terms, or take both actions, subject to applicable law and any required notice or process.
If you do not agree to these Terms, you must not access or use the Platform or its services.
I. ACCEPTANCE
1. Platform operator
OLDBUY is operated by Varun Enterprises. In these Terms, "we", "us", and "our" refer to Varun Enterprises. "Service" refers to the marketplace, listing, and related services made available through the Platform.
2. Scope and acceptance
The Platform and the Service are provided subject to these Terms. "You" and "your" refer to any person who accesses or uses the Platform or the Service, whether manually or through automated means. This includes people who browse content, create or share listings, advertise products or services ("Listed Items"), submit content, or respond to listings, where these features are available. This definition does not itself permit automated access to the Platform.
By accessing or using the Platform or the Service, you agree to comply with these Terms and any applicable guidelines made available for the features you use. If you do not agree to these Terms or applicable guidelines, you must stop using the Platform and the Service.
3. Changes to these Terms and guidelines
We may update these Terms and the applicable service guidelines from time to time. Updated Terms will be made available on the Platform with a revised "Last updated" date. We will provide notice of material changes and obtain any further agreement where required by applicable law. Any notice will state when those changes take effect.
Please review these Terms periodically. If you do not agree to updated Terms, you must stop using the Platform and the Service. Continued use after the updated Terms take effect constitutes acceptance, subject to any additional notice or agreement required by applicable law. Nothing in this section limits rights or remedies available to you under applicable law.
II. DESCRIPTION OF SERVICE AND CONTENT POLICY
OLDBUY, operated by Varun Enterprises, functions solely as an online intermediary platform enabling users who comply with these Terms to advertise, list, discover, buy, and sell Listed Items. Although you may engage in communications, payments, or related services on or through the Platform using third-party vendors or integrated payment processing providers, Varun Enterprises is not a party to, nor involved in, any such user-to-user agreements or transactions. Consequently, you acknowledge and agree that Varun Enterprises exercises no control over any element of such transactions and shall bear no liability or responsibility to any party in connection therewith. You access and use the Platform and its Services entirely at your own risk.
OLDBUY operates strictly as a direct peer-to-peer marketplace. All communications, item inspections, price negotiations, and handovers occur directly between the buyer and the seller. Varun Enterprises does not provide physical product inspections, logistics, or delivery services. Should any optional third-party service be accessed through the Platform, such service shall be governed by the respective provider's terms and conditions, and Varun Enterprises shall bear no liability for independent third-party operations.
OLDBUY provides an online classifieds platform enabling users (“Listers”) to publish and advertise Listed Items. Listers remain responsible for their listings and the accuracy of the information they provide. Varun Enterprises does not own the Listed Items and does not act as a broker, agent, or representative for any buyer, seller, or advertiser.
OLDBUY will make your phone number available to other users for buyer–seller communication only where you expressly choose to share it through the Platform’s contact-sharing controls. The purpose and audience of such sharing will be explained when you make that choice, and personal information will be handled in accordance with our Privacy Policy.
Users are responsible for the advertisements, listing details, descriptions, photographs, and other material they submit through OLDBUY (“Content”). You must ensure that your Content is accurate, lawful, and does not infringe another person’s intellectual property, privacy, or other rights. You are responsible for violations arising from your Content to the extent provided by applicable law.
Content provided by other users may be inaccurate, misleading, offensive, or otherwise objectionable. Before making a payment or agreeing to a transaction, you should independently verify the relevant listing details, the item’s condition, and the seller’s information.
Where the Platform or user Content includes links to third-party websites, those websites are governed by their own terms and privacy policies. Varun Enterprises does not operate or control those websites and does not guarantee the accuracy or authenticity of their content. You should review their terms and independently assess them before sharing personal information or making payments.
Content Ownership and Permissions
As a Lister or advertiser, you are responsible for the Content you submit or make available through OLDBUY. You confirm that you own the Content or have the necessary rights, licences, and permissions to use it and allow its use as described in these Terms. These rights and permissions must remain valid for as long as your Content is available on the Platform.
Where your Content includes another person’s photograph, personal information, or a business’s protected material, you must have any consent or other lawful permission required to publish and use that material. You must not upload Content that infringes another person’s intellectual property, privacy, or other rights.
You retain ownership of your Content. By submitting it to OLDBUY, you grant Varun Enterprises a non-exclusive, royalty-free licence to host, store, reproduce, and display the Content, and to make technical changes such as image resizing, compression, and formatting, solely as necessary to operate the Platform and make your listing available to users. Service providers acting on our behalf may process the Content only as necessary to perform these functions for us.
Other users may view your publicly available Content through the Platform and contact you about your listing using the communication options you have enabled or the contact details you have expressly chosen to share. This does not give other users ownership of your Content or a general right to reuse it outside the Platform.
The licence to display your Content ends when the Content is removed from the Platform. Limited copies may remain for backup, security, dispute resolution, or legal compliance purposes, only for as long as necessary for those purposes and in accordance with our Privacy Policy and applicable law. Such retained copies will not be used to continue publicly displaying the removed listing.
This licence does not grant unrestricted rights to use your personal information or to use your Content in separate advertising campaigns. Personal information will be handled in accordance with our Privacy Policy, your applicable choices and permissions, and applicable law.
Content Endorsement, Moderation and Intellectual Property Violations
Varun Enterprises does not endorse user Content or any opinions, statements, recommendations, or advice expressed in it. Publication or moderation of Content on OLDBUY does not constitute verification or endorsement of the seller or Listed Item, or a physical inspection, certification, or guarantee of the Listed Item.
Users must not upload or share Content that infringes another person’s copyright, trademark, or other intellectual property rights. Upon receiving a sufficiently detailed infringement complaint, Varun Enterprises may review the reported Content and restrict access to or remove it where appropriate, and will take any action required by applicable law.
Varun Enterprises may review, restrict, reject, or remove Content that violates these Terms or applicable law, or where reasonably necessary to address suspected fraud, infringement, safety risks, or misuse of the Platform. Where urgent action is reasonably necessary to address these risks or comply with a legal requirement, action may be taken without prior notice, subject to applicable law and any required notice or process.
Repeated or serious violations may result in the suspension or termination of a user’s access to the Platform. In deciding what action to take, Varun Enterprises may consider the nature, severity, and frequency of the violations. An allegation alone does not automatically establish that a user has committed an infringement. Any action remains subject to applicable notice and process requirements.
Nothing in this section excludes or limits any responsibility of Varun Enterprises, or any user rights or remedies, that cannot be excluded or limited under applicable law.
III. GENERAL GUIDELINES FOR LISTINGS AND ADVERTISEMENTS
A. SUBMISSION GUIDELINES
i. Authority to list and permission to use content
You may submit a listing or advertisement on OLDBUY only if you own the Listed Item or have the necessary authority from its owner or a duly authorised representative to advertise it and offer the proposed transaction. For services, you must have the right and authority to offer the advertised service. Any proposed sale, rental, lease, or other offer must be permitted by these Terms, the categories supported by the Platform, and applicable law.
Before submitting a listing, you must obtain all rights, licences, consents, and permissions required to publish its descriptions, photographs, contact details, and other information. Where a photograph or other material belongs to a photographer, copyright holder, or another third party, permission from the owner of the Listed Item alone does not replace any separate permission required from the relevant rights holder. You must not publish another person’s private contact or financial information without the lawful authority or consent required for that disclosure.
You must accurately describe your relationship to the Listed Item and must not claim to be its owner or an authorised representative unless that is true. The required authority and permissions must remain valid while the listing is available on the Platform. If you lose that authority or permission, you must promptly remove the listing or the affected Content, as appropriate.
Hosting a listing or advertisement does not make Varun Enterprises the owner, seller, broker, or agent for the Listed Item. Publication or moderation of a listing does not itself verify the authenticity of its photographs or information, or the Lister’s ownership or authority. Content ownership, permitted use, and moderation are further addressed in Section II.
ii. Age eligibility and protection of children in advertisements
OLDBUY is intended only for users aged 18 years or older. Persons under 18 years of age must not use the Platform. Varun Enterprises does not promote OLDBUY for use by children.
Regardless of this age restriction, Listers and advertisers must not submit advertisements that exploit, mislead, or endanger children. In particular, advertisements must not:
- Encourage, condone, or depict behaviour in a way that invites imitation that could endanger children, or promote practices harmful to their physical health or mental well-being.
- Exploit children’s inexperience, credulity, loyalty, or susceptibility to pressure; imply that they will be ridiculed or inferior if they do not purchase or use a product; or create a negative body image.
- Directly urge children to buy goods or services or persuade another person to buy on their behalf, including through promotions that require a purchase to participate.
- Misrepresent a product’s price by using expressions such as “just” or “only” while concealing additional costs.
- Exaggerate product features or what an ordinary child can achieve using a product; create unrealistic expectations; or make it difficult for children to understand a product’s size, characteristics, or performance or to distinguish fantasy from real-life situations.
- Feature children in advertisements where prohibited by law, including prohibited advertisements for tobacco or alcohol products; or use sports, music, or film personalities to promote to children products that require health warnings or cannot lawfully be purchased by children.
- Exploit children’s susceptibility to charitable appeals without clearly explaining how their participation contributes to the stated charitable cause.
- Claim that a product improves intelligence or physical ability without valid substantiation, or make health or nutritional claims without adequate scientific evidence.
- Promote medical services, drugs, dietary supplements, medical instruments, cosmetics, alcohol, or cosmetic surgery in a manner adverse to children’s physical or mental health.
- Misleadingly suggest that advertised goods or services are superior to natural or traditional foods consumed by children, or use promotional gifts to pressure children into unnecessary purchases or encourage unreasonable consumption.
These restrictions do not authorise any product, service, or advertisement otherwise prohibited by these Terms or applicable law. Content and account action for violations will be handled in accordance with Section II and applicable notice and process requirements.
iii. Legal compliance, accurate disclosures and cooperation
Listers must comply with all laws and regulatory requirements applicable to their listings, advertisements, and proposed transactions, including requirements relating to licensing, consumer protection, and product safety. You must obtain and maintain any licences or approvals required for the products or services you advertise. You must not engage in unfair, deceptive, or misleading trade practices.
Listings must provide clear and accurate information about the Listed Item, including its description, condition, known material defects, price, additional charges, and clear photographs where relevant. You must not fabricate ratings or reviews or misrepresent customer feedback. Where you advertise in the course of a business, you must accurately identify that business and provide its address, contact information, and other seller disclosures to prospective buyers to the extent required by applicable law. These business-specific requirements do not automatically require a private individual selling a personal item to publish a home address or private phone number.
Before a buyer agrees to a transaction, you must clearly explain any applicable terms concerning returns, refunds, exchanges, warranties, guarantees, delivery or collection, shipping charges, payment, and complaints. If you do not offer a voluntary return, warranty, or delivery service, you must make that clear where relevant. Your stated terms must not exclude rights or remedies that buyers have under applicable law.
Where you offer or arrange payment methods, you must accurately disclose the available methods, applicable fees, and relevant payment conditions before payment. Any information about payment security, recurring-payment cancellation, refunds, or chargebacks must reflect the arrangements actually offered and the relevant payment provider’s terms. You must not claim that OLDBUY provides payment protection, escrow, delivery, or a transaction guarantee unless that specific service is expressly made available by OLDBUY.
Upon a written request from Varun Enterprises, you must provide accurate information reasonably necessary to verify your authority to list, investigate a complaint, support dispute resolution, or comply with applicable law, within the reasonable timeframe stated in the request or any applicable legal deadline. Depending on the request and your status as a private or business Lister, this may include relevant contact details, business addresses, licence details, website or email details, or the terms of the disputed offer. Personal information supplied for these purposes will be handled in accordance with our Privacy Policy; supplying it does not by itself authorise public disclosure of private contact details.
You must follow the listing policies, rules, and guidelines made available through OLDBUY that apply to your use of the Platform. Updates to those policies and guidelines are subject to the notice and acceptance provisions in Section I and applicable law.
iv. Listing review, compliance evidence and display
Varun Enterprises may review listings, including listings reported as violating these Terms, and may restrict, reject, or remove them in accordance with Section II. A complaint alone does not establish a violation, although temporary restrictions may be applied where reasonably necessary while a complaint is assessed. These review rights do not limit any action or obligation required by applicable law.
Where reasonably necessary to assess compliance, Varun Enterprises may ask a Lister to provide supporting evidence, such as proof of ownership, authority to advertise, permission to use photographs, or applicable licences. Requests, response timeframes, and the handling of information will follow subsection iii above. If reasonably required evidence is not supplied within the stated timeframe, the affected listing may remain restricted or be removed, subject to applicable notice and process requirements.
Repeated or intentional violations may result in account suspension, termination, or refusal of further access to the Service, taking into account the nature, severity, and frequency of the violations and subject to Section II and applicable law.
By publishing a listing, you permit its public Content to be searchable, displayed, and viewed by other users through the Platform. Users may refer to the listing when considering or discussing the advertised offer. Downloading, copying, or sharing is permitted only to the extent authorised by these Terms, the listing owner, applicable law, or a feature expressly provided by OLDBUY for that purpose. This clause does not grant a general right to reproduce, republish, or commercially exploit another user’s Content outside the Platform, and does not override contact-sharing choices or the Privacy Policy.
Varun Enterprises may determine how listings are organised, categorised, and displayed through the Platform and may make technical changes, such as image resizing, compression, or formatting, within the Content licence described in Section II. This does not authorise changing a seller’s price, item condition, or other substantive offer details without the Lister’s approval. Where substantive corrections are needed, Varun Enterprises may request that the Lister update the listing or restrict or remove it under these Terms.
B. GUIDELINES FOR POTENTIAL BUYERS AND LISTERS
i. Independent checks before a transaction
Before making a payment or agreeing to a transaction, prospective buyers and Listers should independently assess the relevant listing, the other party’s authority, and the proposed terms. The checks should be appropriate to the Listed Item and the nature of the transaction. In particular:
- Authenticity and suitability: Prospective buyers should verify that the Listed Item exists, matches its description, and is suitable for their intended use, purchase, or rental. Buyers should arrange any independent checks they consider necessary at their own expense, unless otherwise agreed with the Lister.
- OLDBUY’s role: Listings and advertisements are supplied by users. Publication or moderation on OLDBUY does not constitute verification, endorsement, or a guarantee of the Listed Item or the Lister. Varun Enterprises may review reports and take action in accordance with Section II; such review does not replace independent checks by the parties.
- Ownership and authority: Where relevant, buyers should check the seller’s identity and evidence of ownership or authority to sell, rent, lease, or provide the advertised item or service. Listers must accurately represent their authority and provide relevant information as required under Part A above.
- Inspection: Where practical and appropriate, buyers should inspect the Listed Item before payment or handover. For permitted property listings, this may include a site visit; for other items, it may include checking their condition and operation. Parties should arrange any meeting or inspection safely and lawfully. OLDBUY does not provide physical inspections or certifications.
- Documents: Where documents are relevant to the transaction, buyers should check that they are valid, current, and consistent with the Listed Item and the person offering it. A photograph or copy of a document alone should not be treated as conclusive proof of authenticity. Parties should share only information reasonably necessary for verification and protect unrelated personal or financial details.
- Applicable requirements: Buyers and Listers must comply with the legal requirements applicable to their own role in the transaction. Where relevant, buyers should check required licences, registrations, approvals, or other evidence concerning the advertised offer and seek qualified advice when needed. Independent checks do not relieve the Lister of its own obligations.
- Transaction terms: Before committing, the parties should clearly agree on the price, additional charges, payment method, collection or delivery arrangements, and any applicable returns, refunds, warranties, or other conditions. Varun Enterprises does not negotiate or conclude user-to-user transactions, act as either party’s agent, or guarantee their completion. Features that enable users to discover listings or communicate do not make Varun Enterprises a party to their agreement.
These are general, non-exhaustive precautions and do not guarantee that a transaction is safe or that a Listed Item is genuine. Any category-specific rules published by OLDBUY apply in addition to these guidelines. Nothing in these guidelines limits rights, remedies, or obligations that cannot be excluded under applicable law.
ii. Cars and bikes
Before purchasing a car or bike advertised on OLDBUY, buyers should independently check the vehicle, its documentation, and the seller’s ownership or authority to sell. Buyers and sellers must fulfil the requirements applicable to their respective roles under the Motor Vehicles Act, 1988, the Central Motor Vehicles Rules, 1989, and applicable state and registering-authority requirements.
- Documents and ownership: Check the registration certificate (RC), seller’s identity and authority, insurance, and a valid Pollution Under Control (PUC) certificate where applicable. Match the registration, chassis, and engine details, as applicable, against the vehicle and relevant records. Where relevant, check outstanding finance or hypothecation, taxes, challans, and restrictions that may affect transfer or lawful use.
- Condition and lawful use: Arrange an independent physical inspection, preferably by a qualified mechanic, to assess the vehicle’s condition, roadworthiness, and safety features. Check applicable emission requirements and any local age, registration, or usage restrictions before purchase. A listing, photograph, or document alone is not a guarantee of roadworthiness or eligibility for use in the intended location.
- Ownership transfer: Both parties must cooperate in completing their respective reporting and application requirements within the applicable deadlines. For a normal sale, this includes the seller’s transfer notice in Form 29 and the buyer’s application in Form 30, as applicable. Obtain a No Objection Certificate (NOC), including through Form 28 where required, and any relevant financier consent or other documents required by the registering authority. Confirm the current process with the relevant RTO or official Parivahan service.
- RTO attendance and records: Complete the online or in-person steps required for the particular transfer. Attend the registering authority if required by its applicable procedure; physical attendance is not assumed to be mandatory for every transaction. Keep copies of the sale and handover record, submitted forms, acknowledgements, and payment records, and follow up to confirm that the RC transfer has been completed.
Varun Enterprises provides the advertising platform and does not inspect or certify vehicles, undertake RC transfers, or attend an RTO on either party’s behalf. Buyers and sellers are responsible for completing their respective transaction and transfer steps. OLDBUY does not adjudicate ownership or payment disputes between the parties; reports of fraud or policy violations may still be reviewed under Section II. Nothing in this clause limits any obligation of Varun Enterprises or any user rights or remedies that cannot be excluded under applicable law.
iii. Mobiles
Before purchasing a mobile phone advertised on OLDBUY, buyers should physically inspect the device and independently check that its model, specifications, condition, and functionality match the listing. Relevant checks include the display, cameras, microphone, speakers, charging, battery condition, connectivity, and any disclosed damage, repairs, or replaced parts.
Buyers should check the device’s International Mobile Equipment Identity (IMEI) number or numbers using the Department of Telecommunications’ official Sanchar Saathi/CEIR handset verification service and follow its current guidance. Where available, compare the IMEI details on the device with those on the purchase invoice and packaging. If the official service flags the IMEI as blacklisted, duplicate, or already in use, buyers should avoid purchasing the device and seek clarification through the official service. An IMEI check alone does not establish the seller’s ownership, the device’s condition, or the absence of all restrictions.
Listers must reasonably cooperate with these checks, accurately disclose known defects and restrictions, and provide available proof of purchase or other relevant evidence of their authority to sell. Before handover, sellers should back up and remove their personal data and remove their own accounts and activation locks through authorised procedures. Buyers should confirm that the device can be set up for their use. Neither party should disclose account passwords or OTPs to the other or attempt to bypass another person’s security controls.
OLDBUY provides the advertising platform and does not physically inspect, certify, or guarantee the authenticity, ownership, condition, or IMEI status of listed mobile phones. Reports of suspected fraud or policy violations may be submitted for review under Section II. Nothing in this clause limits obligations or user rights that cannot be excluded under applicable law.
iv. Electronics and appliances
Before purchasing an electronic device or appliance advertised on OLDBUY, buyers should independently check its model, specifications, age, condition, functionality, included accessories, and suitability for their intended use. Where practical, buyers should arrange a safe demonstration or inspection before payment or handover. Products requiring specialist testing or installation should be assessed by a qualified technician; buyers should not attempt unsafe electrical tests or bypass safety features.
Buyers should check whether applicable BIS certification, registration, or other mandatory safety requirements apply to the product. Where a product bears a BIS Standard Mark or registration number, buyers should verify the relevant licence or registration details using official BIS resources, such as the BIS Care app, and compare the details with the product and manufacturer. A certification mark alone does not establish the present condition or safety of an individual used, repaired, or modified item.
Before agreeing to the transaction, buyers should confirm any claimed warranty or guarantee, including its provider, remaining duration, coverage, exclusions, transferability, and required proof of purchase. Any seller-provided return or refund terms, and any installation, transport, or additional charges, should be clearly agreed. A manufacturer’s warranty must not be assumed to transfer automatically to a subsequent owner.
Listers must reasonably cooperate with these checks and accurately disclose known defects, repairs, modifications, replaced parts, and whether an item is used or refurbished. They must not misrepresent certification or warranty coverage, conceal known safety hazards, or offer products contrary to applicable safety requirements. Available invoices, warranty documents, and relevant certification details should be provided for verification where reasonably requested, with unrelated personal information protected.
OLDBUY provides the advertising platform and does not test, inspect, install, certify, or provide a warranty for listed electronic devices or appliances. Reports of suspected misrepresentation, unsafe products, or policy violations may be submitted for review under Section II. Nothing in this clause limits obligations or user rights that cannot be excluded under applicable law.
v. Commercial vehicles and spare parts
Before purchasing a commercial vehicle or spare part advertised on OLDBUY, buyers should independently verify its condition, authenticity, suitability for the intended use, and the Lister’s ownership or authority to sell. Buyers and Listers must comply with the requirements applicable to their respective roles under the Motor Vehicles Act, 1988, the Central Motor Vehicles Rules, 1989, and relevant state and transport-authority rules.
For commercial vehicles, buyers should check the registration certificate, insurance, fitness certificate, permits, and Pollution Under Control (PUC) certificate where applicable. They should verify relevant document details, validity, outstanding finance or other restrictions, and whether the vehicle may lawfully be used for the intended purpose and location. Buyers must not assume that an existing permit automatically transfers with the vehicle; the parties should confirm the required transfer, renewal, or fresh application process with the relevant authority and complete their respective obligations.
Buyers should arrange an independent inspection by a qualified mechanic or appropriate specialist to assess the vehicle’s roadworthiness, safety features, maintenance condition, and relevant modifications. For spare parts, buyers should check the manufacturer, part number, condition, and compatibility with the intended vehicle model and variant, and seek professional advice or installation where appropriate. Applicable notified safety and performance requirements, including relevant AIS or Indian Standards where prescribed, should be checked for the particular vehicle or component. A general claim that a part is “AIS approved” or “compatible” should not replace supporting information or an appropriate assessment.
Listers must reasonably cooperate with these checks and provide available ownership records, invoices, maintenance information, and relevant approval or certification details where reasonably requested. They must accurately disclose known defects, material repairs or modifications, and whether spare parts are new, used, refurbished, or aftermarket. Listers must not misrepresent compatibility, approvals, or warranty coverage, or advertise counterfeit parts or items whose sale is prohibited by applicable law. Any offered warranty, return terms, installation service, or additional charges must be clearly explained before the transaction.
OLDBUY provides the advertising platform and does not inspect or certify commercial vehicles or spare parts, guarantee compatibility or roadworthiness, arrange installation, or undertake registration or permit transfers. Reports of suspected fraud, unsafe items, or policy violations may be reviewed under Section II. Nothing in this clause limits obligations or user rights that cannot be excluded under applicable law.
vi. Furniture
Before purchasing furniture advertised on OLDBUY, buyers should independently inspect its design, dimensions, materials, condition, and suitability for the intended space and use. Relevant checks include stability, joints, fittings, moving parts, upholstery, visible damage, signs of pests or moisture, and any missing components. Buyers should confirm access and measurements for collection, transport, and installation before agreeing to the transaction.
For wood-based furniture, buyers should seek clarification of the material described in the listing, such as solid wood, veneer, plywood, or other engineered wood, and request available supporting information for claims about species, origin, or quality. Appearance alone should not be treated as proof of the material or its authenticity. Where specialist assessment is needed, buyers should seek advice from a qualified carpenter or furniture professional.
Listers must comply with applicable product safety and quality requirements, including the Furniture (Quality Control) Order, 2025, as amended, where it applies to the particular product and transaction, taking account of relevant commencement provisions and exemptions. Where certification is required or claimed, buyers should check relevant markings and licence details through official BIS resources. Certification alone does not establish the present condition, durability, or safety of an individual used, repaired, or modified item.
Listers must reasonably cooperate with inspection and verification, accurately describe the furniture’s materials and condition, and disclose known defects, repairs, modifications, or infestations. Before purchase, the parties should clarify maintenance needs, any claimed load limits or durability, applicable warranty coverage and transferability, return terms, and responsibility for dismantling, packing, collection, transport, and assembly, including any additional charges. Claims about materials, certification, or warranty must not be misleading.
OLDBUY provides the advertising platform and does not inspect, authenticate, certify, transport, assemble, or provide a warranty for listed furniture. Reports of suspected misrepresentation, unsafe items, or policy violations may be reviewed under Section II. Nothing in this clause limits obligations or user rights that cannot be excluded under applicable law.
vii. Books, sports and hobbies
Before purchasing books, sports equipment, or hobby-related items advertised on OLDBUY, buyers should review the description and, where practical, physically inspect the item to confirm its condition, completeness, authenticity, and suitability for their intended use.
For books, buyers should confirm the title, author, publisher, edition, language, and ISBN where available, and check for missing pages, markings, damage, or missing supplements. For sports equipment and hobby items, buyers should check the model, size, included parts or accessories, working condition, and any signs of excessive wear, repairs, or damage. Equipment whose failure could cause injury should receive an appropriate specialist assessment where needed; buyers should not rely on appearance alone as proof of safety.
Listers must accurately describe the item and reasonably cooperate with relevant checks. They must disclose known defects, missing components, repairs, and any limitations affecting use. Claims that an item is original, branded, signed, rare, or collectible must be accurate and supported by available evidence where reasonably requested. Listers must have the right to sell the item and must not offer counterfeit goods, pirated copies, or other items whose sale infringes intellectual property rights. These restrictions do not prohibit the lawful resale of genuine items.
Before completing the purchase, the parties should clarify any offered return or refund terms, warranty, included accessories, and collection or delivery arrangements and charges. If the item includes an access code, digital supplement, subscription, or software licence, the Lister must accurately disclose its availability, activation status, and any known restrictions on transfer or use. Buyers should not assume that such access automatically transfers with a physical item.
OLDBUY provides the advertising platform and does not physically inspect, authenticate, value, certify, or provide a warranty for listed books, sports equipment, or hobby items. Reports of suspected counterfeiting, infringement, unsafe items, or policy violations may be reviewed under Section II. Nothing in this clause limits obligations or user rights that cannot be excluded under applicable law.
viii. Other listed items, services and advertisements
Items, services, and advertisements not specifically covered by the category guidelines above remain subject to these Terms, OLDBUY’s applicable listing policies, and relevant legal and regulatory requirements. The absence of a category-specific guideline does not permit an otherwise prohibited item or service to be listed. Only offers permitted within the categories supported by OLDBUY may be advertised.
Listers and advertisers must ensure that they have the authority, qualifications, licences, registrations, and approvals required for their particular offer, where applicable. They must accurately describe the item or service, disclose material limitations and known risks, and comply with the obligations applicable to their role. Buyers’ independent checks do not relieve Listers or service providers of these responsibilities.
Before paying or entering into an agreement, prospective buyers should carry out checks appropriate to the item or service. These may include reviewing the Lister’s or service provider’s identity, authority, relevant qualifications, experience, and required licences, and independently checking credentials through the relevant issuing body where appropriate. Available customer reviews may inform a decision but should not be treated as conclusive proof of authenticity, competence, or satisfactory performance.
The parties should clearly agree on the item specifications or service scope, deliverables, completion times, total price and additional charges, payment schedule, and any applicable cancellation, return, refund, warranty, or after-service terms. They should also clarify how complaints or disputes will be raised and handled. Any agreed dispute process must not exclude rights or remedies that cannot be waived under applicable law. Listers and service providers must reasonably cooperate with relevant questions and requests for supporting information, while protecting unrelated personal information.
OLDBUY provides the advertising platform and does not perform the advertised service, certify a provider’s competence, or guarantee an item, deliverable, or transaction outcome. Reports of suspected fraud, misleading claims, or policy violations may be reviewed under Section II. Nothing in this clause limits obligations or user rights that cannot be excluded under applicable law.
IV. CONDUCT
You must ensure that the descriptions, photographs, and other Content you provide on OLDBUY accurately represent the goods or services you advertise, including their appearance, nature, condition, quality, intended purpose, and other material features. You must not use misleading images or statements, conceal known material defects or limitations, or make claims that you cannot reasonably substantiate. If material information becomes inaccurate or outdated, you must promptly correct it or remove the affected listing.
You must use the Platform lawfully and in accordance with these Terms. You must not post, host, display, upload, modify, publish, transmit, store, update, or share prohibited Content through the Platform, including through any messaging or other communication features made available by OLDBUY. These obligations apply to listings and advertisements as well as any other Content you make available through the Service, and must be read together with the content restrictions in Sections II and III.
A. Prohibited content
You must not make available Content that:
- Violates applicable law, regulations, or binding directions of a competent authority.
- Infringes copyright, trademarks, patents, trade secrets, privacy, publicity, or other rights; belongs to another person without the necessary permission for its use; or breaches a contractual, confidentiality, or fiduciary obligation. Any permissions must cover the uses authorised under these Terms.
- Is threatening, abusive, defamatory, obscene, pornographic, sexually exploitative, or invasive of another person’s privacy, including bodily privacy; sexually exploits or otherwise harms children; or encourages money laundering, unlawful gambling, violence, or other unlawful conduct.
- Harasses, degrades, intimidates, or promotes hatred or violence against a person or group based on religion, caste, gender, sexual orientation, race, ethnicity, nationality, age, or disability. Religious disagreement or criticism alone is not treated as prohibited harassment under this clause.
- Contains discriminatory employment requirements or preferences contrary to applicable law, where employment advertisements are permitted on the Platform.
- Unlawfully threatens India’s unity, integrity, defence, security, sovereignty, public order, or friendly relations with other countries; incites criminal conduct; or obstructs a lawful investigation.
- Discloses another person’s private identifying, contact, or financial information without their explicit consent or another lawful authority for that disclosure.
- Impersonates a person or organisation, including Varun Enterprises or OLDBUY staff, or falsely claims an affiliation, authorisation, or endorsement.
- Falsifies the origin of a message, uses forged sender details or manipulated identifiers to conceal its source, or knowingly presents false or misleading information as fact. Fraudulent offers and bait-and-switch advertisements are prohibited.
- Promotes pyramid schemes, chain letters, junk messages, unsolicited commercial advertising, affiliate marketing, or referral-code promotions unless a particular promotional activity is expressly permitted by OLDBUY. Permission for a promotion does not permit fraud or spam.
- Places advertisements in areas or categories not intended for them, or sends commercial messages to users who have declined such contact.
- Includes links to commercial services or third-party websites unless permitted by OLDBUY’s applicable listing rules or an expressly available feature. Permitted links must not be used for phishing, fraud, or evasion of these Terms.
- Advertises illegal services, prohibited goods, or regulated goods or services without the permissions required by applicable law and OLDBUY’s listing policies.
- Contains malware, viruses, or code designed to damage, interrupt, obtain unauthorised access to, or impair software, devices, networks, or other resources; or floods communication channels so that other users cannot reasonably use the Service.
B. Prohibited activities
You must not:
- Engage in unfair or unlawful price manipulation, including exploiting essential needs or extraordinary circumstances to impose unjustified prices contrary to applicable consumer-protection requirements. Ordinary lawful pricing and negotiation are not prohibited merely because a price differs from another listing.
- Arbitrarily discriminate between consumers of the same class in a manner that infringes their rights under applicable consumer-protection law.
- Stalk, threaten, harass, or defame another person; continue unwanted contact after being asked to stop; or send unsolicited commercial approaches, including offers to repost a user’s advertisement on another website or act on their behalf.
- Harvest or collect other users’ personal information for unsolicited marketing, resale, or unlawful purposes. This does not prevent information sharing that the user expressly authorises for a legitimate transaction in accordance with these Terms.
- Scrape, bulk-download, or extract Platform data using bots, crawlers, spiders, or data-mining tools without express authorisation. Public search engines and non-commercial public archives may access publicly available web pages only to the extent permitted by our published robots.txt directives and applicable access rules; this does not authorise access to private data or bypassing restrictions.
- Misrepresent a listing’s location, post locally irrelevant Content, repeatedly post duplicate or substantially similar advertisements, or impose unreasonable loads on the Platform. Posting the same offer in multiple categories or locations is permitted only where expressly allowed by OLDBUY’s listing rules or features.
- Attempt unauthorised access to accounts, systems, or data; bypass security or access restrictions; or disrupt, degrade, or interfere with the Platform’s operation.
- Abuse reporting or other community controls, including by knowingly making false reports, targeting competitors without a reasonable good-faith basis, or using automated reporting tools without express authorisation. A report that is ultimately unsubstantiated is not, by itself, proof of abuse.
- Use unauthorised software or automated devices to create, submit, schedule, or repeatedly publish listings, including bulk postings. Any automation expressly provided or authorised by OLDBUY remains subject to its applicable limits and these Terms.
C. Action on violations
Content or conduct that breaches these Terms, applicable law, or applicable privacy requirements may result in content restrictions or removal, account suspension or termination, or other action described in Section II. Varun Enterprises may preserve relevant records and respond to lawful requests from competent authorities in accordance with applicable law and the Privacy Policy. Suspected unlawful activity may be subject to investigation by the appropriate authorities.
Decisions and any required notices or procedures will follow Section II and applicable law. An allegation alone does not automatically establish a violation, and nothing in this Section excludes obligations or user rights that cannot be excluded under applicable law.
V. PAID SERVICES
OLDBUY may offer optional paid features for posting listings, enhancing their visibility, or accessing other expressly described Platform features ("Paid Services"). Only the features actually offered to you and identified in the relevant purchase flow form part of the package you purchase. Paid Services do not include unlimited messaging or any other benefit unless that benefit is expressly stated in the package description.
Before you confirm a purchase, the applicable price, taxes and additional charges, included features, duration, usage limits, and any relevant activation or reset conditions will be made available to you. Any cancellation, refund, expiry, or renewal conditions applicable to that package must also be disclosed before purchase. Availability may vary by listing category, location, account eligibility, or purchase channel, as explained in the relevant offer.
By purchasing a Paid Service, you enter into an agreement with Varun Enterprises for the package described at the time of purchase, subject to these Terms and the disclosed package conditions. The Content, conduct, and listing requirements in these Terms continue to apply to paid listings and features. Payment does not exempt a listing from moderation or guarantee approval, a particular number of views or enquiries, or a completed sale, unless a specific measurable benefit is expressly included in the offer.
Fees for Paid Services relate to OLDBUY’s Platform features and are separate from any payment agreed between a buyer and a seller for a Listed Item. The availability of Paid Services does not make Varun Enterprises a party to that user-to-user transaction or a provider of inspection, delivery, or transaction guarantees.
Changes to offers for future purchases do not by themselves alter the features, price, or duration already purchased. Any proposed change affecting an existing purchase must comply with the disclosed purchase conditions, these Terms, and applicable law, including any required notice, consent, or remedy.
Paid Services and the agreement between you and Varun Enterprises are governed by the laws of India, subject to any mandatory rights or protections that apply. Nothing in this Section excludes rights or remedies that cannot be excluded under applicable law.
A. Featured Ads
Where offered, Featured Ads is an optional Paid Service that gives an eligible listing enhanced presentation, such as placement in a designated featured area or visual highlighting within OLDBUY. The placement, presentation, and supported surfaces included in the purchase will be described in the relevant offer. Featured status does not mean that Varun Enterprises has verified or endorsed the seller or Listed Item.
Featured listings may share available placements with other listings and may be rotated or ordered according to the display arrangements described in the offer. Unless expressly included in the purchased package, a Featured Ad is not guaranteed a fixed position, continuous display, or visibility on every visit or search. Display may depend on relevant category, location, search filters, and available placements, as applicable to the offered feature.
Featured Ads are intended to draw attention to listings, but do not guarantee a particular increase in views, enquiries, offers, or sales unless an express measurable commitment forms part of the purchased package. Any performance estimates must be identified as estimates and must not be misleading; this clause does not override an express commitment made in the offer.
The featured duration, activation conditions, and any deadline for using the feature will be disclosed before purchase. If the underlying listing’s expiry date can shorten the featured period, that limitation and the resulting duration must be clearly disclosed before payment. No automatic 30-day cutoff applies unless it is expressly included in the purchased offer. The effect of marking a listing as sold, deleting it, or having it restricted or removed, including any applicable refund or credit arrangements, will be governed by the disclosed package conditions and applicable law.
Single-listing purchases or packages covering multiple Featured Ads may be offered. The number of included uses, eligibility requirements, usage limits, package expiry, price, and any discount will be stated in the offer. Availability of a package does not imply unlimited postings or permission to create duplicate listings contrary to these Terms.
Any feature-specific restrictions on editing a Featured Ad, including changes to its category, location, or advertised item, must be disclosed before purchase. Editing does not restart or extend the purchased period unless the package expressly provides otherwise. Listings must remain accurate, and users must be able to request correction or removal of inaccurate Content through the Platform’s available support or listing-management channels. Featured Ads remain subject to the listing and moderation requirements in these Terms.
B. Minimum Response Packages
Where expressly offered by OLDBUY, a Minimum Response Package is a Paid Service that provides specified visibility features and a commitment to a stated minimum number of qualifying buyer responses during a defined period. Availability is limited to the categories, locations, accounts, and listings identified in the relevant offer. This clause does not itself make such a package available or create a response commitment for other Paid Services.
Before purchase, the offer must state the minimum response target, qualifying response definition, counting method, measurement period, activation conditions, and whether the target applies to each listing separately or to the package as a whole. It must explain how repeat contacts, unique buyers, spam, automated messages, invalid enquiries, and responses received before activation are treated. Views or impressions must not be described as buyer responses. Varun Enterprises must not fabricate responses or use artificial activity to satisfy the commitment.
Any requirements to activate or use a specified number of listing credits, keep listings active, or wait until a defined measurement period has ended must be clearly disclosed before payment. The offer must also explain how unused credits, listing expiry, edits, early deletion, marking an item as sold, or moderation action affect the commitment and any remedy. Expiry of every listing is not an automatic condition unless expressly stated as part of the offer, subject to applicable law.
If the stated response target is not met and the disclosed eligibility conditions have been satisfied, Varun Enterprises will provide the remedy expressly promised at purchase. The offer must identify whether that remedy is a refund, an extension, a credit, or another specified remedy, together with any refund amount or calculation, claim procedure, claim deadline, and processing timeframe. An expressly promised refund will not be replaced with a credit or extension without the purchaser’s agreement, except as permitted by applicable law. Additional eligibility conditions must not be introduced after purchase to deny the promised remedy.
A qualifying response does not necessarily represent a verified buyer, a firm offer, payment, or a completed transaction. A minimum-response commitment is not a guarantee of sale, sale price, or transaction completion. OLDBUY must not describe a response-only package as a “Guaranteed Sale” package. Any separate sale guarantee would require its own expressly offered and clearly defined terms.
All listings included in a Minimum Response Package remain subject to these Terms. Nothing in this clause limits rights or remedies that cannot be excluded under applicable law.
Property Minimum Response Packages
Where a Minimum Response Package is expressly offered for property listings with the remedy described in this subsection, a purchaser whose qualifying-response target is not met within the disclosed period and who meets the disclosed eligibility conditions may choose either a complimentary replacement package or a refund, subject to any applicable refund-option limit clearly disclosed before purchase.
Before the purchaser chooses a complimentary package, OLDBUY will explain its features, stated value, duration, activation conditions, and expiry. It may have the same or a lower stated value than the original package, but a lower-value package may be supplied only with the purchaser’s express agreement after those differences are explained. A complimentary package will not be substituted for an available refund without that agreement.
Any refund will follow the amount or calculation, verification requirements, claim procedure, deadline, and processing timeframe disclosed at purchase. Any deductions must be lawful and clearly disclosed before payment. Varun Enterprises will not introduce new eligibility conditions, deductions, or verification requirements after purchase to reduce or deny the promised remedy, except where required by applicable law.
If the offer limits this contractual refund option to two occasions per customer, that limit must be prominently disclosed before each affected purchase. The offer must explain how a customer is identified, the period over which the limit is counted, and what counts as an occasion. Once the limit is reached, any later offer must clearly state before payment that this refund option is unavailable and identify the alternative remedy for an unmet response target. The limit does not exclude refunds or other remedies required by applicable law or retrospectively remove a refund already promised at purchase.
Changes, suspension, or discontinuation of this feature for future purchases do not by themselves remove commitments attached to an existing purchase. Any change affecting an existing package remains subject to Section V and applicable notice, consent, and remedy requirements.
The commitment concerns only qualifying responses as defined in the purchased offer. It does not guarantee buyer seriousness, a particular level of response quality beyond that definition, conversion, sale or rental, or completion of a transaction. This limitation does not allow spam, fabricated responses, or other contacts excluded by the disclosed counting rules to be counted toward the target.
Any supplementary OLDBUY help information made available for the package must be consistent with these Terms and the conditions disclosed at purchase. Later changes to help content do not by themselves change an existing purchase agreement.
C. Boost to Top
Where offered, Boost to Top is an optional Paid Service that moves an eligible, already published and active listing to the top of the relevant listing area for its category and city or location at the time the boost is applied. The applicable listing area, ordering mode, activation timing, and any separate Featured Ad placements or other placement limits will be explained in the offer before purchase.
The boost provides temporary placement rather than a permanently reserved position. The listing may move down as newer listings or other eligible boosted listings appear, according to the disclosed ordering rules. A boost does not guarantee first position across every search, filter, location, or display mode, or a fixed period at the top, unless expressly included in the purchased offer.
Boost to Top is intended to draw attention to an active listing. It does not guarantee a specified number or increase in views, enquiries, offers, or completed transactions unless an express measurable commitment forms part of the purchased package. Any performance estimates must be identified as estimates and must not override an express commitment made at purchase.
A boost does not renew the underlying listing or extend its existing expiry date unless the purchased offer expressly includes a renewal or extension. The listing’s remaining validity and any deadline for using a purchased boost must be disclosed before payment. The applicable expiry is the date shown for that listing; this clause does not impose a separate fixed 30-day validity period.
The offer must state the price, number of boosts included, eligibility conditions, and whether boosts are applied once or on a disclosed schedule. It must also explain how expiry, deletion, sale of the Listed Item, or moderation restrictions affect unused boosts and any applicable refund or credit. Boosted listings remain subject to these Terms, and boosting does not constitute verification or endorsement by Varun Enterprises.
D. Auto Boost
Where offered, Auto Boost is an optional Paid Service that automatically applies Boost to Top to an eligible, already published and active listing at the intervals described in the purchased package. Each scheduled boost is subject to the placement and display conditions in subsection C above, including the relevant category, city or location, listing area, and ordering mode.
Before purchase, the offer must state the price, activation conditions, package duration, number of included boosts or how that number is calculated, and the boost interval or schedule. Any scheduling window, timing variation, or category, location, or account eligibility restriction must also be explained. Different offers may have different schedules, but changes to future offers do not by themselves reduce the frequency, number, or duration of boosts already purchased. Changes affecting an existing purchase remain subject to Section V and applicable law.
Each automatic boost provides temporary placement. The listing may move down between boosts as newer or other eligible boosted listings appear. Auto Boost does not reserve a permanent top position or guarantee visibility on every visit, search, or filter. It does not guarantee a specified increase in views, enquiries, offers, or completed transactions unless an express measurable commitment forms part of the purchased package. Performance estimates must be identified as estimates and must not override an express commitment made at purchase.
Auto Boost does not renew the underlying listing or extend its expiry date unless the purchased offer expressly includes renewal or extension. The listing’s remaining validity, the effective period during which automatic boosts can run, and any effect of listing expiry on the purchased schedule must be disclosed before payment. No separate fixed 30-day listing validity is imposed by this clause.
Automatic boosts apply only while the listing remains active and eligible. The offer must explain the effect of pausing, deleting, marking a listing as sold, changing its category or location, or having it restricted or removed, where those actions are available. It must also disclose how missed or failed scheduled boosts, unused boosts, and any cancellation, refund, credit, or replacement arrangements are handled. Automatic application of boosts does not itself authorise automatic package renewal or recurring charges; any such arrangement requires separate clear disclosure and the purchaser’s agreement.
Auto Boost listings remain subject to these Terms and the moderation requirements in Section II. Use of this feature does not constitute verification or endorsement of the seller or Listed Item by Varun Enterprises. Nothing in this clause limits rights or remedies that cannot be excluded under applicable law.
E. Paid Ads
Where offered, Paid Ads allow you to purchase additional listing capacity after exhausting the applicable free posting allowance in a category. A free posting allowance is the number of eligible advertisements that may be posted without a listing fee during a defined period. Allowances may vary by category, location, account eligibility, or usage, as disclosed through the Platform.
OLDBUY will explain the applicable free allowance, counting period, and reset method in the relevant posting flow. The rules must state which postings count toward the allowance, including the treatment of paid, expired, deleted, rejected, or reposted advertisements and category changes where relevant. A rolling period must be distinguished from a calendar-based reset. This clause does not establish a fixed allowance of three advertisements or a fixed 30-day counting period.
Posting limits are associated with your account under the disclosed counting rules. Changing the phone number associated with the same account does not by itself create a new free allowance or erase its posting history. You must not change account details or create additional accounts to evade applicable posting limits. This does not authorise uses of personal information beyond those described in the Privacy Policy and permitted by applicable law.
You may purchase a single Paid Ad or a package covering multiple postings where available. Before payment, the offer must state the price, taxes and additional charges, number of posting credits, eligible categories and locations, activation or redemption conditions, package expiry, and validity of each resulting listing. Any discount applies only as expressly stated in the offer. The offer must also explain when a credit is consumed and how unsuccessful publication, rejection, deletion, expiry, or unused credits affect any restoration, refund, or other remedy.
Purchasing a Paid Ad provides the posting entitlement described in the offer. It does not include Featured Ad placement, Boost to Top, Auto Boost, or a minimum-response commitment unless expressly included in the purchased package. Payment does not exempt the listing from review or guarantee approval, additional views, a particular number of responses, or a completed transaction. Performance estimates must be identified as estimates and must not override any express measurable commitment made at purchase.
Paid Ads and packages remain subject to these Terms and the conditions disclosed at purchase. Changes affecting existing purchases are governed by Section V. Nothing in this clause limits rights or remedies that cannot be excluded under applicable law.
F. Smart Connect Packages
OLDBUY offers Smart Connect, Smart Connect Plus, and Smart Connect Bulk as seller listing packages in the Mobiles category, subject to availability in the purchase flow. These packages provide the listing capacity, validity, visibility features, and buyer-connection benefits described in the selected offer. Listing credits authorise eligible postings; they are not tokens for purchasing access to another user’s phone number.
For an eligible listing, Smart Connect can display up to five masked buyer recommendations at a time, subject to the availability of matching buyers who have opted into the recommendation feature. Recommendations use available interest and listing information, such as category, subcategory, location, and relevant search or interest terms. Results may change as that information changes or expires. A relevance score is a matching indicator, not a probability of purchase, identity verification, or endorsement. Five recommendations are an upper limit, not a promise that five suitable buyers will always be available.
A seller may send a call request through the available Smart Connect controls. The buyer may accept or decline. Contact access through this request flow is enabled only after acceptance and is limited to the participants in the accepted request. Purchasing a package or viewing a recommendation does not itself authorise disclosure of a buyer’s private phone number. Participants must use shared contact information only for the relevant enquiry, respect requests to stop contact, and comply with the Privacy Policy and these Terms. Acceptance does not guarantee that a call will be answered or a transaction completed.
Smart Connect variants have different benefits. Any included badges, featured placement, listing-level removal of external advertisements, Auto Boost schedule, listing allowance, and validity must be stated in the purchased offer. A plan-related badge does not itself certify identity, ownership, product condition, or transaction safety. Any statement about increased calls or visibility must accurately describe its basis and limitations and must not override an express commitment made at purchase.
Where Smart Connect Plus includes response assurance, the stated response target, measurement period, counting rules, and refund-claim conditions apply in accordance with subsection B and the purchased offer. The availability of a refund claim means that the claim is subject to eligibility review; it is not an automatic refund on submission. The current claim process counts qualifying responses at listing level, so the offer must clearly explain whether each eligible listing carries its own target. Benefits of Plus or Bulk are not automatically included in the single-listing package.
Package validity and posting-credit limits are those disclosed at purchase. Expiry, unused credits, failed service delivery, and applicable cancellation or refund remedies are governed by the disclosed package conditions and Section V. Buyer recommendations and call requests do not guarantee buyer seriousness, a particular sale price, or transaction completion. Nothing in this clause limits rights or remedies that cannot be excluded under applicable law.
G. Seller Plans, Badges and Contact Features
OLDBUY’s current paid plans are offered to sellers and Listers; no separate paid buyer subscription is currently offered. Eligible sellers may purchase the listing, visibility, badge, or connection benefits expressly included in the selected plan. This subsection describes those seller benefits and does not establish a separate package named “Elite Seller”. Availability, price, category eligibility, listing allowance, duration, and included features are those disclosed before purchase.
Where a plan includes a seller or package badge, the badge may be displayed on eligible listings or seller-profile surfaces as described in the offer. A badge awarded through a paid plan indicates the corresponding plan status or benefit; payment alone does not establish identity verification, ownership, product authenticity, background checks, or transaction safety. Any separate verification claim must accurately identify the checks actually completed. A badge-only plan does not include listing credits or enhanced placement unless expressly stated in its offer.
Buyers may contact a Lister through the communication options available on the listing. Public display of the seller’s phone number remains subject to the seller’s express contact-sharing choice described in Section II. Purchase of a seller plan does not authorise access to a buyer’s private phone number. Smart Connect call requests and contact access remain subject to the buyer-acceptance process in subsection F. Where a contact number is unavailable or has not been shared through an authorised flow, a seller plan does not override that restriction.
Featured placement, boosts, and other visibility benefits apply only where included in the purchased plan and are governed by the relevant provisions of this Section. A seller badge or subscription does not by itself promise priority placement in another user’s chat inbox, vehicle price estimates, or any other feature absent from the purchased offer. Listers remain responsible for accurate listing information and the price they choose to advertise.
Seller plans do not guarantee a completed sale, a particular selling price, or a minimum or maximum number of responses unless an express response commitment is included in the purchased package. Where response assurance is included, subsection B, subsection F where relevant, and the disclosed package conditions continue to apply; this general clause does not cancel those commitments.
Cancellation, refund, and credit eligibility will follow the conditions disclosed before purchase and applicable law. Lack of a completed sale does not by itself create an additional refund entitlement beyond those conditions and applicable rights. However, purchase does not waive remedies for service non-delivery, failure to meet an express commitment, or other circumstances where a remedy is required by applicable law. All seller plans remain subject to the Content, conduct, and moderation provisions of these Terms.
H. Buyer Chat Access and Usage Restrictions
OLDBUY currently does not require buyers to purchase a subscription or paid package to initiate or continue ordinary chats with sellers through the Platform. The current seller plans do not create a paid buyer-chat allowance, a paid unlock requirement, or an exemption from chat safety rules. Smart Connect recommendations and accepted call requests remain separate seller-plan features governed by subsection F.
Users may initiate and continue chats through the available Platform features, subject to login, participant access controls, user blocking, and these Terms. This clause does not impose a fixed number of free new chats or a compulsory waiting period after a particular number of chats. It also does not promise unrestricted messaging regardless of safety controls or service availability.
OLDBUY may restrict messaging where reasonably necessary to address spam, harassment, automated activity, fraud, security risks, or other violations, in accordance with Sections II and IV and applicable law. Such protections apply to buyers and sellers. Users must respect another user’s decision to block or stop contact and must not use another account or communication method to evade that decision.
If OLDBUY introduces a general new-chat quota in the future, the affected users will be informed of the applicable limit, counting rules, reset method or waiting period, and effective date before it applies, subject to applicable law. A restriction limited to initiating new chats will not by itself restrict replies in existing conversations; separate user blocks, safety restrictions, or account action may still apply. Any future paid buyer-chat feature would require its own clear offer and purchase agreement and is not authorised or activated by this clause. Changes remain subject to Section I and applicable notice and consent requirements.
I. Seller Badge
OLDBUY offers a paid seller-badge benefit, currently labelled “Verified Seller Badge” in the package catalogue, either as a standalone seller package or as an included benefit of an eligible listing plan. This is a seller feature, not a paid buyer subscription. The applicable price, activation conditions, duration, display locations, and included benefits will be disclosed before purchase.
The current badge is granted as a paid-plan benefit. It does not by itself establish that Varun Enterprises has conducted AI-based identity verification, document authentication, background checks, or an assessment of the seller’s trustworthiness. It does not certify ownership, product authenticity, legal compliance, or transaction safety. The meaning of the badge must be clearly explained where it is offered or displayed; any separate verification claim must accurately describe checks actually completed.
The standalone badge package provides badge access for the period stated in the purchased offer and does not include listing credits, Featured Ad placement, boosts, priority support, or a verified-user search filter unless expressly included. Where the badge is bundled with another plan, the eligibility and validity stated for that plan apply. No particular number of views, enquiries, responses, or completed transactions is guaranteed by the badge alone.
The badge is linked to the purchasing or entitled seller account and may not be transferred, sold, or represented as certification of another person or business. Continued eligibility depends on compliance with these Terms. Varun Enterprises may temporarily restrict the badge while reasonably investigating suspected misuse and may remove it for established violations or loss of eligibility, subject to the review, notice, and action provisions in Section II. A report alone does not automatically establish misconduct.
The badge entitlement ends when its disclosed validity expires unless renewed under an available offer. Any renewal price, duration, activation conditions, or recurring-payment arrangement must be clearly disclosed and agreed to before charging. Automatic renewal and advance renewal reminders are not included unless expressly stated in the offer. Changes affecting an existing entitlement remain subject to Section V and applicable law.
Refund, credit, and extension eligibility following cancellation, suspension, removal, or service failure will follow the conditions disclosed at purchase and applicable law. This clause does not impose a blanket forfeiture of all refunds or remedies. The badge does not replace either party’s independent checks before a transaction, and nothing in this clause limits obligations or user rights that cannot be excluded under applicable law.
J. Posting Allowances and Package Validity
OLDBUY’s current seller listing packages provide a specified number of posting credits for a defined validity period. You may use the remaining credits for eligible listings while the package is active. The applicable allowance, eligible categories, activation date, and expiry will be disclosed in the purchase flow and account records. A badge-only package does not provide posting credits unless expressly stated.
For the current package model, validity runs from payment approval and activation for the duration assigned to that package. A listing published using the package inherits the package expiry for its associated plan benefits. Publishing a listing near the end of the package period does not start a fresh 30-day entitlement or extend that package. The remaining period of paid benefits and any separate rules governing the listing’s continued publication must be clearly distinguished in the offer. Package-benefit expiry does not, by itself, establish that a listing will be deleted.
Unused posting credits cannot be redeemed after package expiry unless an extension or other remedy applies under the disclosed purchase conditions or applicable law. Credit consumption, unsuccessful publication, and refund or credit restoration are governed by subsection E and the relevant purchase conditions.
No unlimited-posting package is currently offered under these Terms. A bulk package with a high numerical allowance remains limited to its stated credits. Any future unlimited offer must expressly describe its validity, eligible categories, any fair-use restrictions, and the effect of package expiry on listings before purchase. Such an offer is not created by this clause.
K. Payment for Paid Services
Paid Services must be purchased through the payment methods and instructions actually displayed in OLDBUY’s authorised purchase flow. The current flow uses UPI and submission of the requested transaction reference or payment evidence for processing. This clause does not promise payment through PayU, cash collection, cards, or net banking unless that method is expressly made available in the purchase flow.
Paid entitlements are activated after the payment request reaches the approved status and the corresponding package entitlement is issued. Initiating a payment, opening a payment app, or submitting a reference or screenshot alone does not constitute confirmation that the service has been activated. Where a payment is pending, failed, duplicated, or debited without activation, users should use the available support channel and retain the transaction reference for resolution under the applicable payment and refund conditions.
You must be authorised to use the payment account or method and must provide accurate payment information. You must not submit fabricated payment evidence or reuse a transaction reference to obtain multiple entitlements without authorisation. Do not share UPI PINs, account passwords, or OTPs with Varun Enterprises, other users, or anyone claiming to assist with payment. Any external payment app or provider is also subject to its own applicable terms; this does not remove Varun Enterprises’ obligations for the Paid Service purchased from it.
Before payment, the purchase flow must disclose the total amount payable, applicable taxes and additional charges, and whether the displayed price includes those amounts. This clause does not assume that Varun Enterprises is GST-registered or that every displayed amount includes GST. Any applicable invoice and tax treatment must reflect the actual transaction and applicable law.
If a GSTIN or business-invoice facility is made available, the purchaser must supply accurate billing details within the communicated process and timeframe. Availability of input tax credit depends on applicable law and the relevant invoice and transaction conditions; providing a GSTIN does not itself guarantee credit. Failure to provide a GSTIN does not establish that the purchaser is unregistered. No GSTIN-entry or tax-credit facility is promised where it is not offered.
Payment for OLDBUY’s seller plans is separate from payment for a Listed Item between users. Cancellation, refunds, service failures, and any expressly promised remedy remain subject to the conditions disclosed at purchase, this Section, and applicable law.
L. Refunds and Cancellation
Voluntary non-use or cancellation. Unless the purchased offer provides otherwise or applicable law requires a remedy, choosing not to use an activated Paid Service, allowing credits to expire, or voluntarily deleting, deactivating, or marking a listing as sold does not by itself entitle you to a refund, credit, or extension for unused time or units. Any cancellation facility and its effect on activation, unused credits, and remaining validity must be disclosed before purchase. This provision does not apply as a blanket exclusion of remedies for service failure or an unmet express commitment.
Minimum-response commitments. Claims for an unmet response target are governed by subsection B, the relevant package conditions, and subsection F where applicable. Eligibility may be reviewed against the disclosed requirements, but an expressly promised remedy will not be denied merely at Varun Enterprises’ discretion once those requirements are met. Any property-package refund limit applies only as described in subsection B and does not override mandatory legal remedies.
Technical failures. If a confirmed purchase cannot be activated or a paid feature cannot be used because of a technical failure attributable to OLDBUY, you should report the issue through the available support channel with the payment reference, affected listing or package, and relevant error details. Varun Enterprises will review the payment and service records to determine the affected entitlement. A payment reference or screenshot alone does not determine the outcome of that review.
Where an unused unit was lost, consumed without delivery, or could not be used because of a confirmed Platform failure, the remedy may include restoring the affected unit, supplying an equivalent unit, or extending the affected validity under the purchase conditions and applicable law. The restored benefit must have a reasonable opportunity for use. If restoration is not practicable or a refund is required under the purchased offer or applicable law, the applicable refund will be provided. A promised refund will not be replaced with a credit without the purchaser’s agreement except as permitted by law.
For example, if a package contains three Featured Ad units, two were successfully delivered, and one could not be used because of a confirmed Platform failure during its validity, the remedy would ordinarily relate to the affected unit rather than the two delivered units. The appropriate remedy depends on the failure and applicable rights; this example does not limit remedies for a wider service failure.
Content violations and edits. Restriction or removal of a listing for an established breach of these Terms does not by itself create a refund entitlement. The disclosed package conditions, the nature of the breach, the service already delivered, and applicable law will determine any remaining entitlement or remedy. A report of abuse alone does not automatically establish a violation or disqualify a claim. Editing a listing does not automatically forfeit all remedies: restrictions caused by a prohibited edit will be distinguished from a Platform defect occurring during a permitted edit, in accordance with the review process in Section II.
Claim handling. Any applicable claim deadline, required information, refund calculation, lawful deductions, processing timeframe, and repayment method must be disclosed in the relevant offer or refund information before purchase. Users must provide accurate information and must not seek duplicate compensation for the same affected entitlement. Varun Enterprises will communicate the claim outcome and, if a claim is rejected, the reason and any available review route. Nothing in this clause limits rights or remedies that cannot be excluded under applicable law.
VI. DEVICE LOGIN CONFIGURATION
To help protect accounts and prevent unauthorised account sharing, OLDBUY applies the following limits to simultaneous active device sessions:
- Free accounts: One active device session at a time.
- Accounts with an active paid seller plan or boost package: Up to two active device sessions at a time. This benefit does not establish a separate paid buyer subscription.
Each device must successfully complete the authentication process supported by OLDBUY. If a new sign-in would exceed the applicable limit, OLDBUY may require an existing session to be signed out or automatically revoke an older session, based on its last recorded activity. A revoked device must authenticate again before regaining access, subject to the same session limit. These limits concern concurrent sessions and do not prevent legitimate replacement of a device.
When an account no longer has an active qualifying paid entitlement, the free-account limit applies. The account will be informed of the applicable limit, and excess sessions may be revoked under the same process. A change in device access does not by itself delete the account, listings, or stored conversations.
You must keep your login credentials secure and must not bypass session restrictions through device spoofing, unauthorised credential sharing, additional accounts, or automated session manipulation. Using another device legitimately within the applicable limit is permitted. Suspected misuse may result in session revocation or temporary access restrictions; serious or repeated violations may result in account suspension or termination under Sections II and IV. Urgent protective action may be taken where reasonably necessary, subject to applicable law and any required notice or process. A report alone does not establish a violation.
Device and session information used to operate these controls will be handled in accordance with the Privacy Policy. Any security notifications depend on the available notification channels and delivery conditions; a push notification is not guaranteed for every session change.
Changes to device limits or eligibility will be communicated with their effective date in accordance with Section I. Changes affecting an existing paid entitlement remain subject to Section V and applicable notice, consent, and remedy requirements. Nothing in this Section limits rights or obligations that cannot be excluded under applicable law.
VII. PROHIBITION OF POSTING AGENTS
A "Posting Agent" refers to any third-party agency, automated service, or intermediary that publishes listings or advertisements on behalf of others.
OLDBUY strictly prohibits the use of unauthorized Posting Agents or automated ad-posting scripts. All listings must be published directly by the genuine owner or an explicitly authorized representative of the Listed Item.
If a Posting Agent submits a listing without valid authorization or licenses from the original rights holder, that Posting Agent and the submitting user shall be solely liable for all resulting intellectual property breaches, legal claims, damages, and penalties. Varun Enterprises bears no liability or involvement in such unauthorized agency submissions.
VIII. ACCESS TO THE SERVICE
Subject to these Terms, Varun Enterprises grants you a limited, non-exclusive permission to access and use OLDBUY for permitted browsing, buying, selling, and advertising activities, including legitimate business listings in supported categories. This permission does not transfer ownership of the Platform or another user’s Content and may be restricted or withdrawn in accordance with these Terms and applicable law.
Access by unauthorised Posting Agents and automated posting scripts is prohibited as described in Section VII. Except as expressly permitted by these Terms, Varun Enterprises, or applicable law, you must not collect, aggregate, scrape, bulk-download, reproduce, republish, commercially exploit, or create derivative uses of Platform data or another user’s Content. You must not bypass authentication, privacy settings, access restrictions, or technical controls.
General-purpose internet search engines and non-commercial public archives may access publicly available web pages solely for indexing and providing links to the Service, to the extent permitted by OLDBUY’s published robots.txt directives and applicable access rules. Such automated access must use an identifiable user agent and a stable IP address or identifiable address range, and must not impose unreasonable loads. This exception does not cover services specialising in aggregating classified advertisements or competing classified-listing databases, and does not authorise access to private information or unrestricted republication of Content.
You may share ordinary links to publicly available OLDBUY listings or its public home page, including for lawful personal, business, or news-reporting purposes, provided you do not misrepresent the destination or suggest an affiliation, sponsorship, or endorsement that does not exist. Linking does not itself grant permission to copy or display listing photographs, descriptions, personal information, or other protected material on another service. Any such reuse requires the appropriate rights or permission, unless otherwise permitted by applicable law. Good-faith criticism or lawful reporting is not prohibited merely because it is unfavourable to OLDBUY.
Bulk aggregation, automated linking, embedding, or other uses beyond the permissions above require prior authorisation from Varun Enterprises where it controls the relevant rights, together with any separate permission required from Content owners. Any published technical access limits must be observed. Unauthorised use may result in access restrictions or termination under Sections II and IV, subject to applicable notice and process requirements. Nothing in this Section limits rights or obligations that cannot be excluded under applicable law.
IX. NOTIFICATION OF CLAIMS OF INFRINGEMENT
OLDBUY hosts user-submitted listings and Content. Users are responsible for having the rights required to publish their Content, and Varun Enterprises handles infringement reports in accordance with these Terms and applicable law. Its role as an intermediary does not exclude obligations or liabilities that cannot lawfully be excluded.
If you own intellectual property rights or are authorised to act for the owner and believe that a listing or other Content infringes those rights, including by offering counterfeit goods, you may send a good-faith notice to oldbuy317@gmail.com, addressed to Himanshu, grievance contact for Varun Enterprises (OLDBUY), with the subject “Intellectual Property / Counterfeit Report”.
To help identify and assess the issue, please provide:
- Your name, reply contact details, and the rights holder’s identity, together with evidence of your authority if acting on their behalf.
- A description of the protected work, trademark, or other right and relevant supporting information, such as registration details where applicable. Registration is not assumed to be required for every type of right.
- The listing ID, accessible link, screenshots, or other details sufficient to locate the reported Content.
- An explanation of the alleged infringement or counterfeit claim, relevant evidence, and the action requested.
- A statement that you believe in good faith that the reported use is unauthorised, that the information provided is accurate to the best of your knowledge, and that you are the rights holder or authorised to act for them, together with your name or signature and the date.
Do not include passwords, OTPs, or unrelated sensitive documents. Varun Enterprises may request clarification or reasonably necessary evidence, review the report, and restrict or remove Content where appropriate or required by law. Reports will be acknowledged and handled within applicable legal timeframes; urgent or legally mandated action will not be delayed merely because an optional supporting detail is missing.
Where appropriate and legally permitted, the affected user may be informed of the allegation and asked to provide an explanation or evidence of permission. Only information reasonably necessary for handling the complaint will be shared, in accordance with the Privacy Policy and applicable law. A complaint alone does not conclusively establish infringement; repeated or serious established violations may lead to account action under Section II. Knowingly false or abusive reports are prohibited.
This reporting process does not replace any right to approach a competent authority or court. Nothing in this Section limits remedies, notice requirements, or other obligations imposed by applicable law.
X. INTELLECTUAL PROPERTY RIGHTS
Except for user Content and material governed by separate licences, the software, source code, scripts, designs, text, graphics, photographs, audio, video, and interactive features supplied as part of OLDBUY ("Platform Materials") are owned by or licensed to Varun Enterprises and are protected by applicable intellectual property laws. OLDBUY names, logos, and other brand identifiers, and any third-party trademarks displayed on the Platform, remain subject to the rights of their respective owners. Their appearance on the Platform does not grant a right to use them or imply an affiliation or endorsement.
You retain the rights you hold in your own Content. The permissions you grant Varun Enterprises to host and use that Content are described in Section II under "Content Ownership and Permissions". This Section does not transfer ownership of user Content to Varun Enterprises or grant rights beyond those permissions.
You may access and use Platform Materials as necessary for the activities permitted under these Terms, including legitimate browsing, buying, selling, and business listings. Except as expressly permitted by these Terms, the relevant rights holder, a separate applicable licence, or applicable law, you must not reproduce, modify, distribute, broadcast, sell, sublicense, commercially exploit, or create derivative works from Platform Materials. Permitted linking and access under Section VIII remain available; sharing a link does not itself grant permission to republish the linked material.
Where copying, downloading, or printing is permitted, you must retain applicable copyright, attribution, trademark, and other proprietary notices. You must not remove or obscure those notices or represent another person’s material as your own. Third-party and open-source components remain governed by their respective licences, including any permissions or attribution requirements those licences provide. These Terms do not override rights expressly granted under those licences.
You must not circumvent or disable security features, access restrictions, or technical measures controlling the use or copying of the Platform or Platform Materials, except to the extent expressly authorised or permitted by applicable law. You must not reverse engineer, decompile, disassemble, or otherwise attempt to derive non-public source code from the Service except where permitted by applicable law or the relevant software licence.
To the extent protected by applicable law, the original selection and arrangement of Platform Materials and Content are also reserved to the relevant rights holder. Unauthorised bulk copying, mirroring to another server, redistribution, or commercial resale of the Platform or its protected compilations is prohibited, subject to the access permissions in Section VIII and applicable licences and legal exceptions. This does not create exclusive rights over unprotected facts or prevent lawful use of material you own.
Rights not expressly granted remain with their respective owners. Intellectual property complaints may be submitted through the process in Section IX. Nothing in this Section excludes any express Paid Service commitment or limits rights, remedies, or obligations that cannot be excluded under applicable law.
XI. USER SUBMISSIONS AND CONTENT RISK
When using OLDBUY, you may encounter user-generated Content submitted by independent users and other sources. Such Content may be inaccurate, incomplete, misleading, offensive, or otherwise objectionable. Varun Enterprises does not guarantee the accuracy, usefulness, safety, or non-infringing nature of user-submitted Content. Publication or moderation does not itself constitute verification or endorsement of that Content or the associated seller or Listed Item.
You should independently evaluate listings and take checks appropriate to the proposed transaction before relying on another user’s statements, sharing personal information, making a payment, or agreeing to a purchase. The relevant precautions in Section III apply. Users remain responsible for the Content they submit and the representations they make; your independent checks do not relieve them of those responsibilities.
To the extent permitted by applicable law, Varun Enterprises is not responsible for loss arising solely from another user’s inaccurate, misleading, or objectionable Content where Varun Enterprises has complied with its own applicable obligations. This provision does not require you to waive legal rights or remedies that cannot lawfully be waived, and does not exclude responsibility for Varun Enterprises’ own breach of applicable obligations or express commitments under these Terms.
You may report suspected fraud, harmful Content, or other policy violations for review under Section II, and intellectual property complaints through Section IX. Nothing in this Section prevents you from seeking available remedies against the responsible party or approaching a competent authority or court.
XII. INDEMNITY
To the extent permitted by applicable law, you agree to indemnify Varun Enterprises and its employees, officers, and authorised agents acting in connection with OLDBUY against third-party claims and the resulting liabilities, losses, and reasonable, documented defence costs, including reasonable legal fees, to the extent directly caused by:
- Your material breach of these Terms or unlawful use of the Platform.
- Your infringement of another person’s intellectual property, privacy, or other rights through Content you submit or conduct you undertake on the Platform.
- Your fraud, wilful misconduct, or negligence in connection with a listing or advertised transaction.
- Your failure to obtain or maintain the authority, licences, consents, or approvals required for your advertised item, service, or Content, or to comply with legal requirements applicable to your own role.
Ordinary lawful use of OLDBUY does not, by itself, create an indemnity obligation. You are not required to indemnify anyone for losses to the extent caused by their own negligence, wilful misconduct, breach of these Terms, or failure to meet applicable legal obligations. Where more than one party contributed to a loss, your responsibility under this clause is limited to the extent attributable to your covered conduct. This clause does not transfer criminal responsibility or require payment of a penalty that cannot lawfully be indemnified.
Varun Enterprises will give you prompt written notice of a claim for which indemnity is sought, provide reasonably available supporting details, and allow a reasonable opportunity to respond and participate in the defence. A delay in notice will reduce your obligation to the extent it materially prejudices your ability to defend the claim. Both parties will reasonably cooperate and take reasonable steps to avoid or reduce unnecessary losses and costs, while protecting confidential and privileged information.
Where appropriate, the parties may agree that you will manage the defence using suitably qualified counsel reasonably acceptable to Varun Enterprises. Any separate representation or defence arrangement must be reasonable in the circumstances. A claim or allegation alone does not establish your liability. Any demand for reimbursement must identify the basis of your responsibility and be supported by reasonable documentation; disputed liability or amounts remain subject to agreement or determination through the applicable legal process.
Neither party may enter into a settlement that imposes payment, an admission of wrongdoing, or another obligation on the other party without that party’s prior written consent. Varun Enterprises may take action required by law or reasonably necessary to protect the Platform, but such action does not by itself establish an indemnity debt or expand the scope of this clause.
This clause continues after account closure or termination of access only in relation to covered acts or omissions occurring while you used the Service, subject to applicable limitation periods. Later amendments do not retrospectively expand your indemnity obligations for earlier conduct. Nothing in this Section limits rights, remedies, or obligations that cannot be excluded under applicable law.
XIII. NO SPAM POLICY
You must not use OLDBUY’s messaging, call-request, or other communication features, its systems, or its published contact addresses to send spam, unsolicited unrelated commercial promotions, chain messages, phishing links, or fraudulent solicitations. You must not harvest users’ contact details or use information obtained through OLDBUY to build unsolicited marketing lists.
A genuine, relevant enquiry about a listing through its available contact options is permitted, subject to the recipient’s contact choices and these Terms. Publishing a listing or accepting a call request does not constitute consent to unrelated advertising, bulk messages, repeated unwanted calls, or the onward sharing of contact information. You must stop unwanted contact when asked and must not bypass a block by using another account, phone number, or communication channel.
Automated or bulk messaging, message flooding, repeated unwanted call requests, forged sender identities, and attempts to misuse Platform systems for promotions or scams are prohibited unless a specific legitimate activity is expressly authorised by OLDBUY. Such authorisation does not permit fraud, harassment, or communication contrary to a recipient’s expressed choices. Paid seller plans do not provide an exemption from these restrictions.
Users may block unwanted contacts and report suspected spam or scams through the available Platform controls or designated support contact. Varun Enterprises may review relevant reports and supporting information and restrict communications, remove Content, or suspend or terminate accounts in accordance with Sections II, IV, and V(H). Any personal information handled during that review will be treated in accordance with the Privacy Policy and applicable law.
Unauthorised access to or misuse of OLDBUY’s systems may also be referred to competent authorities where appropriate. Any civil or criminal liability depends on the conduct and applicable law and is not automatically established by a spam report or a breach of these Terms. Nothing in this Section limits rights, remedies, or obligations that cannot be excluded under applicable law.
XIV. DEALINGS WITH ORGANISATIONS AND INDIVIDUALS
Your dealings with other users, businesses, or independent service providers in connection with a Listed Item are between you and the relevant parties. These dealings may include enquiries, negotiations, payment, collection, delivery arrangements, warranties, refunds, and other transaction terms. Each party remains responsible for its own representations, commitments, and applicable legal obligations.
OLDBUY provides the advertising platform. Varun Enterprises is not a party to the sale, rental, or service agreement between users, does not act as either party’s agent, and does not guarantee payment, delivery, product condition, or completion of the transaction. You should carry out the relevant checks described in Section III and clearly agree on the transaction terms before committing. The availability of a listing or communication feature does not itself constitute endorsement of another user or provider.
If a dispute arises concerning a user-to-user transaction or an independent third-party service, the parties should seek resolution with each other and may use any available lawful complaint or dispute-resolution process. Varun Enterprises does not act as a court or arbitrator and does not undertake to decide ownership, contractual liability, or compensation between those parties. Any voluntary assistance does not make Varun Enterprises a party to their agreement or guarantee a resolution.
Suspected fraud, harmful Content, or other policy violations may still be reported for review under Section II, and intellectual property complaints under Section IX. Varun Enterprises may take appropriate Platform action and will comply with applicable legal obligations and lawful requests from competent authorities. This clause does not permit required complaint handling or other mandatory action to be disregarded.
To the extent permitted by applicable law, Varun Enterprises is not responsible for losses arising solely from another party’s acts, omissions, or failure to honour a user-to-user transaction where Varun Enterprises has complied with its own applicable obligations. This clause does not require a blanket release of all claims, exclude responsibility for Varun Enterprises’ own breach of its obligations, or prevent you from seeking available remedies against the responsible party.
Purchases of OLDBUY Paid Services are agreements with Varun Enterprises and are governed by Section V, including its activation, service-delivery, cancellation, and refund provisions. They are not treated as independent buyer–seller transactions for the purposes of excluding responsibility under this Section. Nothing in this Section limits rights, remedies, or obligations that cannot be excluded under applicable law.
XV. LIMITATION AND TERMINATION OF SERVICE
A. Usage and storage limits
OLDBUY may set reasonable operational limits on listing counts, upload sizes, supported formats, message frequency, storage, and access to Platform features. Applicable limits and expiry conditions will be communicated through the relevant feature, package description, or published rules. Changes are subject to Section I and, where they affect purchased benefits, Section V. Device-session limits are addressed separately in Section VI.
The period during which a listing is publicly available may differ from the period during which associated information is retained in account records, backups, or records required for legal or security purposes. Retention and deletion will be governed by the Privacy Policy, disclosed service conditions, and applicable law. Users should keep their own copies of important listing information and transaction records; this advice does not exclude Varun Enterprises’ obligations concerning data handling or service delivery.
B. Account identity and duplicate accounts
Accounts are associated with the identifiers and authentication methods supported by OLDBUY. Varun Enterprises may investigate and restrict accounts reasonably identified as duplicates used for impersonation, fraud, ban evasion, or circumvention of posting or usage limits. Where a legitimate account-linking or recovery issue is identified, it may be reviewed through the available support process. Using one account on multiple devices within the permitted session limit is not, by itself, creating a duplicate account.
C. Restriction, suspension and termination
Varun Enterprises may restrict features, disable Content, revoke sessions, suspend an account, or terminate access where reasonably necessary to address material or repeated breaches of these Terms, fraud, harassment, security risks, unlawful activity, or a binding legal requirement. Any restriction should take account of the nature, severity, and circumstances of the issue. A complaint alone does not automatically establish a violation.
Where appropriate, the affected user will receive notice of the action, its reason, and any available opportunity to correct the issue or request review. Immediate protective action may be taken where reasonably necessary to address an urgent risk or comply with law. Notice or details may be limited where disclosure is legally prohibited or would compromise security or a lawful investigation, subject to applicable requirements. Content and account action remain subject to Sections II and IV.
D. Service changes and discontinuation
OLDBUY may update, limit, suspend, or discontinue features for operational, security, or legal reasons. For material planned changes, affected users will be informed of the scope, effective date, and relevant next steps in accordance with Section I. Urgent interruptions may occur without advance notice where reasonably necessary. Changes affecting existing Paid Services, including unused entitlements or failure to deliver a purchased benefit, will be handled under Section V and applicable law rather than automatically cancelling all refund or remedy rights.
E. Effect of termination and review
Following termination, you must stop accessing the restricted Service and must not evade the action through another account, device identity, or third party. You may still use designated support or complaint channels to request review, exercise applicable rights, or resolve an existing payment or data request. Access may resume if reinstatement is authorised by Varun Enterprises.
Termination may result in listings becoming unavailable, but it does not necessarily mean that all associated records are immediately deleted. Account deletion and record retention remain subject to the Privacy Policy and applicable law. Existing paid-service claims, lawful transaction obligations, and provisions intended to survive termination continue to the extent provided by these Terms and applicable law.
Nothing in this Section provides a blanket exemption for loss of Content, storage failures, service interruption, or termination. Varun Enterprises remains responsible for obligations and express commitments that cannot be excluded, and users retain rights and remedies that cannot lawfully be waived.
XVI. DISCLAIMER OF WARRANTIES
A. Platform availability
Subject to the express commitments in these Terms and any purchased offer, OLDBUY is provided on an “as available” and “as is” basis to the extent permitted by applicable law. Varun Enterprises does not promise that the Platform will operate without interruption, delay, or error, or that every feature will be available on every device or at all times. This does not exclude obligations concerning reasonable service delivery, security, or remedies for failure to deliver an expressly purchased benefit.
B. User Content and Listed Items
Listings and related representations are supplied by users. Varun Enterprises does not independently guarantee their accuracy, completeness, usefulness, authenticity, or non-infringing nature, or that a Listed Item is safe, of a particular quality, or suitable for a buyer’s intended purpose. Publication, paid placement, a plan-related badge, or moderation does not itself certify the seller or Listed Item. These limitations do not relieve Listers of their responsibility to provide accurate descriptions and photographs or to disclose known material defects and limitations.
Account or profile information held by OLDBUY does not itself establish independent verification of a person’s identity, ownership, authority, or trustworthiness. Before relying on a listing, making payment, sharing personal information, or meeting another user, you should carry out the checks appropriate to the item and transaction described in Section III. Differences between a photograph and an actual item do not excuse misleading advertising.
C. Transactions and third-party services
OLDBUY does not guarantee that a listing will result in enquiries, an agreed price, a sale, a rental, or any other completed transaction, except for a specific measurable commitment expressly included in a purchased offer. Links, advertisements, and references to third-party products or services do not themselves constitute endorsement or a guarantee of their accuracy, quality, performance, or availability. User-to-user and independent third-party dealings are governed by Section XIV.
Varun Enterprises does not undertake to enforce a buyer–seller agreement, secure delivery or payment, or guarantee a particular outcome in a dispute between users. This does not exclude its responsibility to handle relevant reports, comply with lawful requests, or meet other applicable obligations. Fraud, theft, misleading representations, or other misconduct by a user remain subject to applicable law and the reporting provisions of these Terms.
D. Technical and security risks
Technical faults, interrupted communications, malicious files, and unauthorised activity may affect online services. Users should exercise reasonable care with links, downloads, credentials, and information shared with others. Acknowledging these risks does not waive Varun Enterprises’ applicable privacy, data-protection, or security obligations, or exclude responsibility for its own breach of those obligations. Data handling is further described in the Privacy Policy.
E. Express commitments and available remedies
This Section does not cancel any expressly promised Paid Service feature, response commitment, refund, credit, or other remedy under Section V. Complaints concerning OLDBUY’s own Paid Services may be raised with Varun Enterprises and are not required to be pursued only against a Lister. Reports concerning user Content may be submitted under Section II, and intellectual property complaints under Section IX.
To the extent permitted by applicable law, warranties not expressly given in these Terms or the purchased offer are excluded. Nothing in this Section excludes any warranty, liability, right, or remedy that cannot lawfully be excluded, including applicable consumer remedies or responsibility for Varun Enterprises’ own failure to meet mandatory obligations. No blanket immunity from claims concerning service deficiencies, injury, property damage, or data-security incidents is created by this disclaimer.
XVII. LIMITATIONS OF LIABILITY
A. Scope of limitations
To the extent permitted by applicable law, and subject to the exceptions below, Varun Enterprises and its employees, officers, and authorised agents acting in connection with OLDBUY will not be liable for indirect, incidental, special, consequential, or exemplary damages arising from use of or inability to use the Platform. This includes loss of anticipated profits, business opportunities, or goodwill only to the extent those losses are indirect or consequential in the circumstances and may lawfully be excluded. Merely describing a loss by one of these names does not automatically make it excluded.
These limitations may apply to permitted service interruptions, changes, or restrictions and to reliance on user Content or independent third-party offers, but do not override express commitments or mandatory obligations. Direct losses are not excluded merely because they arose through use of the Platform; responsibility depends on the relevant facts, these Terms, and applicable law.
B. User and third-party conduct
Users remain responsible for their own listings, representations, and conduct. Varun Enterprises does not assume responsibility for another user’s fraud, defamation, unlawful conduct, or failure to perform a transaction solely because the parties connected through OLDBUY. This does not exclude responsibility to the extent a loss results from Varun Enterprises’ own breach of an applicable obligation. Reporting, complaint handling, and available remedies remain governed by Sections II, IX, XI, and XIV, as relevant.
C. Responsibilities and remedies preserved
Nothing in this Section excludes or limits liability for Varun Enterprises’ fraud or wilful misconduct, liability that cannot lawfully be excluded or limited, or applicable consumer, privacy, data-protection, and security obligations. Any liability for death, personal injury, property damage, or other harm that cannot be excluded under applicable law remains unaffected.
The exclusions above do not cancel an expressly promised Paid Service benefit or an applicable refund, credit, restoration, or other remedy under Section V. They do not prevent claims for Varun Enterprises’ own service deficiencies where a remedy is available under applicable law. No monetary liability cap is created by this Section.
D. Access from other jurisdictions
OLDBUY is operated by Varun Enterprises in India. Availability of the Platform outside India does not itself mean that every listing, feature, or advertised transaction is lawful or suitable in that location. Users accessing the Platform from another jurisdiction must comply with laws applicable to their own access and activities and must not bypass lawful geographic or access restrictions. Varun Enterprises remains responsible for obligations applicable to its own operations; this clause does not waive mandatory protections available to a user under applicable law.
These limitations apply only to the extent enforceable under applicable law and must be read together with the express commitments and safeguards elsewhere in these Terms.
XVIII. ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms, including your licence to access and use OLDBUY, without the prior written consent of Varun Enterprises, except where permitted by applicable law.
Varun Enterprises may assign or transfer these Terms and its related rights and obligations in connection with a merger, restructuring, or sale or transfer of the OLDBUY business, subject to applicable law. The receiving entity must assume the obligations transferred to it, including commitments relating to active Paid Services and applicable remedies.
Any such transfer must not reduce your existing contractual benefits or mandatory legal protections. We will notify affected users of a change in the entity responsible for providing the Platform and obtain consent where required by applicable law. Any associated transfer of personal data will be handled in accordance with the Privacy Policy and applicable law.
Any attempted assignment in breach of this Section will have no effect to the extent permitted by applicable law.
XIX. ELIGIBILITY AND ABILITY TO ACCEPT THESE TERMS
By accessing or using OLDBUY, you confirm that you are at least 18 years of age, are legally competent to enter into a binding agreement under applicable law, and can understand and comply with these Terms.
If you use the Platform on behalf of another person, business, or organisation, you confirm that you have the authority required to act on their behalf and to accept these Terms for them.
OLDBUY is intended only for adults. Persons under 18 years of age must not register an account, publish listings, communicate with buyers or sellers, purchase Paid Services, or otherwise use the Platform. Permission from a parent or legal guardian does not make a person under 18 eligible to use OLDBUY. Adults must not allow minors to use their accounts.
Notice to minors and parents or legal guardians: If you are under 18, please do not submit your personal information or create an account on OLDBUY. If a parent or legal guardian believes that a minor has created an account or provided personal information, they should contact Varun Enterprises through the contact details provided in the Privacy Policy so that appropriate action can be taken in accordance with that policy and applicable law.
XX. GENERAL INFORMATION AND DISPUTE RESOLUTION
A. Entire agreement and governing law
These Terms, the policies expressly incorporated into them, and any applicable Paid Service terms disclosed and accepted at purchase form the agreement between you and Varun Enterprises concerning OLDBUY. They supersede prior discussions and understandings on the same subject, without removing accrued rights or expressly agreed benefits under an existing purchase. These Terms are governed by the laws of India.
B. Informal resolution
If you have a dispute concerning OLDBUY or its Services, you may contact Varun Enterprises using the grievance contact details provided on the Platform. The parties will endeavour to resolve the dispute through good-faith discussions within fifteen (15) days after receipt of a written dispute notice. This process does not extend any statutory complaint deadline or prevent either party from seeking urgent relief or exercising a statutory remedy.
C. Arbitration by mutual agreement
If the dispute remains unresolved, the parties may agree in writing to refer a dispute legally capable of arbitration to a sole independent and impartial arbitrator under the Arbitration and Conciliation Act, 1996, as amended. Arbitration is optional under this Section and requires a separate written agreement after the dispute arises. That agreement will specify the arbitrator appointment process, seat, hearing arrangements, language, and costs, subject to applicable law. Neither party may unilaterally appoint the sole arbitrator.
D. Courts and statutory remedies
Subject to applicable law and any valid arbitration agreement, courts in Delhi having competent jurisdiction will have jurisdiction over disputes under these Terms. This does not exclude any consumer commission, statutory authority, or other forum available under applicable law, or restrict a user’s mandatory rights regarding where a complaint may be filed.
E. No waiver and severability
A delay or failure by either party to enforce a provision does not by itself waive that provision or any other right. If a provision is held invalid or unenforceable, it will be severed or limited only to the extent legally permitted and necessary. The remaining provisions will continue to apply.
F. Successors and permitted assigns
These Terms bind and benefit the parties and their lawful successors and permitted assigns, subject to Section XVIII.
XXI. VIOLATIONS OF TERMS AND REMEDIES
A. Reporting violations
If you become aware of a suspected violation of these Terms, please report it through the reporting tools available on OLDBUY or the grievance contact details provided on the Platform. Please provide sufficient information to identify the relevant listing, account, or conduct.
B. Action against violations
Subject to applicable law and the relevant provisions of these Terms, Varun Enterprises may investigate reported or detected violations, remove or restrict Content, limit access, or suspend or terminate accounts. Such action may address spam, unauthorised automated posting, circumvention of access restrictions, unlawful copying or scraping, and other prohibited conduct. Any applicable notice and review procedures will continue to apply.
C. Compensation for loss
Where your breach of these Terms causes loss to Varun Enterprises, we may seek reasonable compensation for losses and costs recoverable under applicable law. Any claim will identify the alleged breach and the basis and calculation of the amount sought, supported by evidence where required by law. This Section does not impose an automatic fixed fine or authorise an automatic debit from your payment method.
Disputed claims will be addressed through the applicable process under Section XX. Varun Enterprises will not recover compensation more than once for the same loss, including through overlapping claims under the indemnity provisions.
D. Court orders and other remedies
Varun Enterprises may seek an injunction or other relief available under applicable law to prevent or stop unlawful conduct or a breach of these Terms. Any such relief is subject to the requirements and discretion of the competent court or authority, including any applicable security requirements.
E. No waiver and preserved rights
A delay or failure to act against a violation does not by itself waive the right to act against that or a subsequent violation. Nothing in this Section limits mandatory consumer protections or remedies available under applicable law.
